TERMS AND CONDITIONS

ALPADA, LLC (“Alpada”, “Alpada Doors”, “we”, “our”, or “us”) operates  this website and and is dedicated to offering our customers (“Customer(s)”, “your” or “you”) with high quality steel/aluminum & glass doors and partitions, and other products (“Product”). At Alpada Doors, customer satisfaction is our top priority. We are committed to delivering exceptional service, quality, and communication. Please review the following information and terms prior to placing an order through our website. By purchasing our Product, you agree to be bound by these Product terms and conditions (“Terms and Conditions”):

1. GENERAL PRODUCT INFORMATION

All Alpada Products are manufactured overseas. Minor differences in Alpada Products are normal and to be expected in the final products. Such minor differences are not considered defects. Steel is a natural material and is never flawless. Natural imperfections in the steel, glass, and components will vary within reasonable tolerances and are considered standard in the industry.

It is important to understand that exposure to natural elements and frequent use will cause Alpada Products purchased and ordered through our site to naturally age. Any damages or changes to the Products resulting from frequent use or exposure to the elements are considered part of the organic aging process and are not defects covered by these Terms and Conditions.

We reserve the right, in our sole and absolute discretion, to improve Products and make changes in specifications, designs, and options at any time without prior notice and without incurring any obligations.

We strive to provide accurate descriptions of our products. However, we do not warrant that the descriptions are complete, reliable, current, or error-free.

2.  WARRANTIES INFORMATION AND EXCLUSIONS

Alpada provides warranties for our Products sold through our website, guaranteeing they will be free from certain defects for one (1) year from the date of receipt. No one is authorized to modify or expand this warranty. These warranties are subject to specific exclusions, limitations, and restrictions outlined herein. Please review these terms before placing an order.

If you believe you have a warranty claim within the specified period due to a defect in your Product, you must email photos of the Product along with a brief description to info@alpadadoors.com. Our customer service team will review the information and determine, at its sole discretion, whether the claim is covered under our warranty policy as outlined herein. The date of defect will be determined by Alpada and will not precede the date the Customer first notified Alpada of the defect. If our customer service team confirms the defect is covered by our warranty, we will replace the defective Product or parts deemed defective.

The warranties provided do not cover and Alpada is not responsible for:

(i) Materials and Labor Costs:

  • (i)(a) Removal, uninstallation, and re-palletizing of the Product for return.
  • (i)(b) Reinstallation of new Products or units.
  • (i)(c) Damage to the finish occurring during unloading, improper cleaning during construction, or drying/cracking due to the use of foreign chemicals, hose water (hard water), or acidic water.
  • (i)(d) Any finish work related to flooring, paint, drywall, construction, exterior finish, or labor.
  • (i)(e) Normal wear and tear from use of Alpada Products, including, but not limited to, door, door hardware, window hardware, hinges, weather stripping, and factory finish.

(ii) Glass-Related Issues:

  • (ii)(a) Scratched or broken glass.
  • (ii)(b) Glass that has been cleaned with foreign chemicals leading to seal/silicone failures.

(iii) Product Handling and Installation:

  • (iii)(a) Any failures due to accident, misuse, abuse, alteration, faulty building construction, or exposure to the elements without proper finishing.
  • (iii)(b) Failure to protect Products during any and all construction or finish work, including, but not limited to, waterproofing Products.
  • (iii)(c) Improper handling, storage, installation, maintenance, force majeure, or acts of God.
  • (iii)(d) Damage caused by corrosive elements.
  • (iii)(e) Rust issues.
  • (iii)(f) Damage to screens for doors & windows.

(iv) Construction and Trades:

  • (iv)(a) Damage to Products caused by other trades during construction for any reason, including, but not limited to, improper cleaning, installation, taping, paint, drywalling, stucco, sanding, chipping, and the use of rotary and tools.

These limitations and exclusions are the sole responsibility of the Customer.

3.  BUILDING CODES DISCLAIMER

Alpada does not guarantee that any information or content provided on its website complies with building codes, ordinances, or regulations for specific applications or jurisdictions. We are not liable for orders or Products that fail to meet city or state code requirements. It is the responsibility of the Customer, building owner, architect, contractor, and installer to ensure that selected Products comply with local building codes, regulations, plans, specifications, and permits.

Please note, Alpada Products are not fire-rated as the steel and glass are glued together.

4. INSTALLATION

Alpada does not offer installation services for its products. However, we provide instructional materials in English on our website and include an English paper manual inside the product packaging. Customers have the option to hire a recommended third-party installer, select another installer of their choice, or install the product themselves.

5. INDEMNITY

Customer agrees to indemnify, defend, and hold harmless Alpada, its members, managers, employees, contractors, agents, representatives, and affiliates from and against any and all liability, claims, losses, costs, and expenses, including attorneys’ fees, arising from:

(i) Customer's violation or breach of these Terms and Conditions; (ii) Customer's violation of any third party's rights, including but not limited to trademark, copyright, proprietary, privacy rights, or regulations.

This indemnification obligation will survive the termination of these Terms and Conditions.

6. TRANSFER OF TITLE

Title and risk of loss for all Alpada Products transfer to the Customer as described below. Any loss or damage occurring after the title of the Product transfers to the Customer is the Customer's sole responsibility.

6.1. Delivery by Alpada: Title and risk of loss for Products delivered by Alpada within the continental United States (excluding Alaska and Hawaii) transfer to you upon delivery.

6.2. Customer Pickup: Title and risk of loss for Products picked up by the Customer transfer immediately upon loading.

7. RETURN POLICY FOR STOCK PURCHASES

7.1. Eligibility and Conditions

Within thirty (30) days from the date stock Products are delivered and prior to installation or any attempted installation, you may return your purchase to Alpada for a partial refund.

7.2. Return Process Requirements

To initiate a return, you must adhere to the following requirements:

i. Contact Alpada at info@alpadadoors.com to obtain a Return Material Authorization (RMA) form. Products cannot be returned without this form.

ii. Retain and use all original crating and packaging materials for the return shipment.

iii. Ensure the Product is undamaged and remains in its original condition as delivered.

iv. Assume responsibility for all costs associated with return shipping and liability for any damages during transit.

v. Ship the Product back to Alpada and ensure it is received before any new Products are shipped (No cross shipping).

7.3. Fees and Refunds

i. A restocking fee of twenty-five percent (25%) will apply to all returns or exchanges. Alpada reserves the right to refuse returns or charge additional fees for any incurred damages.

ii. Delivery fees are non-refundable.

iii. Refunds will be issued using the original method of payment.

7.4. Shipping Costs

Shipping costs, including those covered under free shipping offers, are one-way only. Customers are responsible for all return shipping expenses.

7.5. Additional Information

For any inquiries about your Product before or after shipment, please contact an Alpada representative who will gladly assist with any questions or concerns.

8. RETURN POLICY FOR CUSTOM ORDERS

Custom orders at Alpada are meticulously tailored to your specific requirements and are therefore non-refundable and non-returnable. Once production begins on a custom order, it cannot be canceled, returned, or refunded for any reason. This policy ensures that each custom-made product meets your unique specifications and expectations.

We encourage thorough review and confirmation of all details, including dimensions, finishes, and specifications, before placing a custom order. Our team is available to assist and clarify any questions you may have prior to finalizing your order to ensure accuracy and satisfaction.

9. SHIPPING AND DELIVERY POLICIES

9.1. Processing Times

Orders are processed and shipped Monday through Friday from Columbus, Ohio. Once your order is paid for and payment is confirmed, it will be prepared for shipment. Please note that credit card processing may take up to three (3) business days, depending on the accuracy of the information provided by the Customer. Delivery will be carried out in accordance with the delivery company's policies.

9.2. Shipping Destinations

We ship to any residential or commercial address within the continental United States (excluding Alaska and Hawaii). Deliveries to Hawaii and Alaska require the Customer to arrange for the order to be picked up from an Alpaca-approved location. All shipments are curbside delivery only, without exceptions. Delivered Products will be offloaded at the destination but will not be unpacked, set up, or placed in any specific area within your home or business. Any changes to the delivery address will incur a fee with the carrier.

9.3. Delivery Dates

Product delivery dates must be scheduled via email or phone as listed on this website. Any modifications to the delivery date or address must be received in writing and communicated to the Alpada office at least forty-eight (48) hours before your scheduled delivery date and time. Normal delivery hours for large items are from 8 am to 5 pm local time. Expect a transit time of 3-15 business days for standard shipping, unless otherwise specified by an Alpada representative in writing. This approximate transit time is based on the location and conditions of the delivery.

9.4. Failure to Accept Delivery

If the Product arrives at the delivery location during the agreed-upon date and time and you do not or cannot accept the delivery for any reason, you will incur additional fees, including redelivery fees and storage fees (“Additional Fees”), which must be paid prior to the redelivery of your Product. For your convenience, a tracking number and other delivery information will be provided once your order ships from Alpada. You will be responsible for Additional Fees if your Product is undeliverable due to the conditions described above.

9.5. Lead Times and Delivery Dates

All lead times and delivery dates provided by Alpada, whether written or oral, including but not limited to online, e-commerce, website, phone, invoice, estimate, order tracking via website, order tracking via email, sales forms, and logistics forms, are estimates and are subject to change at any time with or without notice. The most current estimates of delivery times are posted on the Alpada website. Lead times for custom orders will be provided by the Alpada managers.

9.6. Shipping Costs

The Customer does not have to pay any amount to the delivery personnel at the time of delivery or at any other time. Alpada is responsible for making direct payments to the shipping and delivery vendors. Any payments made by the Customer to the carrier company or its representatives for additional or existing services will be at the Customer’s sole cost. You acknowledge and agree that Alpada will not refund such payments under any circumstances. Some orders may be eligible for free shipping. Alpada does not offer price adjustments for orders charged shipping at the time of purchase. Free shipping is one way only and does not apply to returns.

10. INSPECTION AND CLAIMS

10.1. Inspection and Liability

Alpada inspects each Product prior to shipment. However, Alpada is not liable for any damages that occur during, upon, or after delivery.

10.2. Visible Damage

 The consignee must inspect the freight for any visible damage and record any obvious damage to the crate upon delivery. According to NMFC rules, the consignee does not have the right to open and inspect the shipping containers before signing for the freight. If the shipping package appears to have significant damage, do not open the freight package and refuse the shipment. Contact Alpada Customer Service immediately to report the refusal. Please note that by refusing the shipment, you may wait 3-5 weeks for resolution. If minimal damage is present on the package, the consignee MUST notify the carrier with all details of the damage (e.g., torn packaging material, black marks on the container).

10.3. Concealed Damage

If damage is discovered after delivery, it must be reported to Alpada Customer Service immediately and no later than three (3) days after receipt of the Product(s) to be eligible for a claim. Once you contact Alpada, we will provide the carrier information for the consignee to file a claim with the carrier. The carrier may complete an inspection, and you must retain the freight and shipping packaging until resolution is given.

Important: For both visible and concealed damages, the consignee must report any damage marks on the shipping packaging to the carrier during delivery to be considered eligible for a claim resolution. Failure to do so will result in the refusal of your claim. The carrier and Alpada are not responsible for any unreported claims or claims made past three (3) days from receipt.

11. PRIVACY POLICY

11.1. Information Collection, Usage, and Security

We collect personal information such as your name, email address, shipping address, and payment information when you make a purchase. We use your information to process your orders, communicate with you, and improve our services. We do not sell or share your personal information with third parties except as necessary to process your orders. We implement reasonable security measures to protect your personal information; however, we cannot guarantee the absolute security of your information.

Any communication or other materials you submit to Alpada or this website related to products, designs, completed forms, custom orders, or any other topics will be treated as non-confidential and non-proprietary submissions. Any submissions made to public areas, including product reviews, are not subject to our Privacy Policy.

11.2. Email Subscription

By subscribing, you agree to receive regular email updates and promotions from Alpada. You can unsubscribe from these communications at any time by clicking the unsubscribe link in the email footer or by contacting us directly.

11.3. Copyright

All content on this site (text, graphics, specifications, logos, drawings, designs, etc.) is the property of Alpada and is protected by United States and international copyright laws. Except as otherwise specifically provided on the site, none of the material may be copied, reproduced, downloaded, distributed, republished, displayed, or transmitted in any form or by any means without prior written permission from Alpada.

12.  REMEDIES

Alpada reserves all rights to pursue any and all legal remedies available to it in the event of a breach of these Terms or any other agreement with Alpada, including without limitation, injunctive relief and recording mechanics liens. 

13. GOVERNING LAW

These Terms and Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United States.

14. CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.
